Nearly everyone who begins the process of getting custody of their child or children wants to know what their chances of winning are or what they can do to win custody of their kids. First and foremost, this isn’t necessarily about what parent comes out on top. Obviously if this is a case where one parent is a danger to the child or provides an unhealthy environment, physically and psychologically, it would be a matter of one parent winning custody. What the above point refers to is the fact that family law and deciding custody arrangements is about what is best for the child or children. Coming at this from this perspective, any parent going through the motions of court and/or attorneys would do well to prioritize what is important in their particular issue. This could mean a lot of different things. It could mean making a list of everything that needs to be addressed in the court room, comparing living situations between parents or having a professional third part come in to assess the well being of one parent, both parents or the children involved.

It’s hard to start this process, nobody is going to deny that. Whether you’re a mother or father there needs to be a process to organize what you have to do to accomplish your goal. What to do to get started, what to expect in the court room, what the difference between legal and physical custody, knowing when you’ve been served and how to respond; these are the things one needs to keep in mind and factor into any decision you might make and knowing what that decision means and the consequences it can can have. Aside from the logistical factors involved in these kinds of child custody or visitation issues, another equally important element to take into account is the emotional and psychological aspect of the people that are involved in a case like this; namely the children.

There’s a lot that goes into winning a child custody case. Knowing is half the battle and any knowledge you can gain before your court date or during the whole process will give you an edge. It’s an unfortunate truth that some parents will do everything they can to not let the mother or father get to see their child out of spite or anger. As a parent, it is devastating to not be able to be with your children. If you are faced with a vindictive ex, the best thing you can do is to be prepared to counter any claim they make in the court room. Being calm and rational will make a difference in your case if your ex is obviously blowing things out of proportion as a means to gain the judges favor.

Lastly, be reminded that “winning” isn’t just in the court room. We want to encourage parents that winning these disputes also includes being successful co-parents and remaining civil with each other after the decision has been made by the courts. To accomplish this requires a lot of self-control, humility, compromise, and selflessness. It may be difficult or even impossible to think about in some cases, but persevere. Your children, once they are grown, will be forever grateful and will become better people.

And then how to deal with the inevitable ongoing litigation that abusive ex spouses often wage against their coparents. Especially as it pertains to how courts perceive abuse.     My ex and I have agreed on joint custody with no fighting or disagreement. I can not find out how to get a court date set up. Nobody will help or give me advice. I have no money or I would hire a lawyer.please help. David

    • Hi David,
      To protect this agreement you and your ex have you will want to get into family court and file papers. Typically, you will want to file in the county that your child has been residing for the last 6 months. Some courts have what is called a family court facilitator that can help parents who are representing themselves to get their paperwork in order and ready to file. You definitely want to get a court order in place defining the agreement that you have or want to have with your ex.

    It is refreshing to see a blog that stands for something important and actually responds to its readers with sincerity and thoughtfulness. Due to the nature of my work, I see many blogs (most of them law related) which seem to only exist for the purpose of self promotion and if they ever do respond to comments, they normally say about five words or offer a generic response that lacks any trace of human element. I applaud the work you do here and the information you provide to those in need. Many of the people who find this blog are likely under some degree of duress depending on the issue they are facing, and it is great to see that you understand that and respond accordingly as well as answer questions in detail that they would normally have to pay someone to answer for them.
